Can You Smoke in Public in Boston?

What’s the Penalty for Smoking in Public? 

Consuming recreational marijuana in public or on federal land, or smoking it in a designated non-smoking area, comes with a fine of up to $100.
Just like alcohol, there are open container laws for public places and vehicles, as well. This comes with a fine of $500.

What About in the Car?

It is not legal to consume marijuana or possess an open container in your vehicle. Store your weed in a closed container in a secure place like your glove box or your trunk.
Operating Under the Influence (OUI) is a serious offense in the state of Massachusetts. Charges can include probation, a mandatory 16-week program, and/or a 45-90-day suspension of your license. Don’t smoke and drive.

What About Possessing in Public?

You’re allowed to possess marijuana in public areas or federal land provided you’re of legal age (21+) and it’s stored in a closed container. Up to 1 ounce of flower or 5 grams of concentrate is permitted.
Again, the fine for an open container is $500, which is pretty steep, so be sure to lock it away before you go out in the city.
