What if you’re undergoing cancer treatment and you want to visit family, but you need MMJ Or maybe you’re relatively healthy, but you could really use the relaxation of a calming indica when it comes to spending the holidays with your entire family.
When you travel to another place, can you take your cannabis with you? Although several states (37 currently) have now legalized the use of medical marijuana for certain conditions, and 18 (plus the District of Columbia) have legalized recreational marijuana, it remains illegal at the federal level. This means you could have trouble transporting cannabis, depending on where you’re going and your mode of transportation. What should you know before you get on a plane or start your road trip?
Can You Travel With Cannabis?
If you live in a state where purchasing and possessing cannabis is legal, you can certainly transport it throughout the state, as long as you observe associated DWI laws, open container laws, and other regulations. Also, you might not want to bring it along to national parks or other areas considered federal land. Unfortunately, it is illegal to transport marijuana, whether medical or recreational, across state lines, even between states where it is legal.
You cannot take it by car, train, boat, plane, or any other mode of transportation. Doing so constitutes a federal crime and could result in a range of penalties, including fines or jail time, depending on the amount, how many offenses a person has, and so on. Transport within a state where cannabis hasn’t been legalized could also result in penalties at state or local levels. If you’re traveling to a state where medical or recreational cannabis is legal, the best thing you can do is purchase your preferred products for personal use when you arrive, if you’re eligible. Exceptions to the Rule
There are two exceptions to travel rules surrounding cannabis products. The first is that you are allowed to travel anywhere in the U.S. with prescribed, FDA-approved cannabis products. To date, there is only one of these: the seizure medication Epidiolex. You can also travel with hemp CBD products featuring 0.3% or less THC that the 2018 Farm Bill has federally legalized.
If you’re visiting Boston but have been unable to transport your cannabis with you on your trip, you’ll be happy to hear that it’s completely legal to purchase adult-use cannabis products. You must be age 21 or older and present a valid, government-issued ID to purchase cannabis or cannabis products in Massachusetts, but it doesn’t matter if you’re a state resident or out-of-state visitor.
Unfortunately, out-of-state visitors cannot purchase medical marijuana in the state of Massachusetts. You must be a resident and a Registered Qualifying Patient (or caregiver) to purchase MMJ products. With that being said, if visitors meet the criteria, they’re welcome to purchase recreational products at local dispensaries or place an order for cannabis delivery in Boston during their stay.
